1. Waiting Time

Prices are based on the assumption that discharge will occur without unreasonable delay. The first 30 minutes on site are free of charge; beyond this, waiting time fees apply unless otherwise agreed prior to delivery, in accordance with current rates set by Concrete King.

2. Out of Hours

Our standard working hours are Monday to Friday, 7:00 AM to 5:00 PM, and Saturday, 7:00 AM to 12:00 PM. Additional charges will apply for services outside these hours.

3. Access

Orders are accepted on the understanding that the delivery site is accessible via a hard road. Our drivers are authorized to refuse delivery if they believe there is a risk of damage to the vehicle. If delivery is aborted for this reason, you will be responsible for any incurred costs. Concrete King accepts no liability for damage to your roads, property, or others' property caused by the vehicle. You are responsible for making good any damage to our vehicle or harm to our personnel caused by defects in the access road or negligence by you or your employees.

4. Water

Any additional water added to the mix to adjust strength or workability is done at the customer's request and risk, and will be noted on the Delivery Ticket/Invoice.

5. Cancellation

Cancellations made at least 3 hours before dispatch will not incur charges, except where materials have been specially processed. In such cases, you will be liable for the costs incurred. Once materials are delivered, they must be paid for in full.

6. Part Load

A surcharge applies for part loads following a full 8m³ load of the same mix on the same day, based on the quantity not carried.

7. Returned Concrete

A disposal and handling fee will be charged for any surplus concrete returned. This is in addition to the cost of the concrete ordered and produced.

8. Defects

Concrete King supplies concrete in accordance with third-party quality management systems, conforming to BS EN 206-1 and BS 8500 unless otherwise stated. Our liability for defects in ready-mixed concrete, including non-compliance with specifications, is limited to the cost of removal and replacement. Liability is contingent upon:

• No additional water or material being added after our agent or employee has declared the product ready for acceptance.
• Sampling being conducted during discharge in accordance with BS1881 and BS5328.
• Proper procedures for sampling, making, curing, and testing of specimens being followed as per BS1881 and BS5328.
• Test results being interpreted in line with BS5328 or any pre-agreed specifications.
• Prompt notification of any test results indicating possible failure to meet specifications.
• Our opportunity to investigate any alleged defects and recommend remedial actions.

9. Consequential Loss

Concrete King is not liable for any consequential loss or damage under any circumstances.

10. Delays

We reserve the right to suspend or delay delivery without penalty in the event of war, civil unrest, strikes, fires, adverse weather, transportation delays, plant or vehicle breakdowns, or other unforeseen events.

11. Price Variation

Quoted prices are based on current material and labor costs. We reserve the right to adjust prices in response to cost fluctuations, with prior notice.

12. Acceptance

This quotation is valid for 7 days and is conditional upon written acceptance within this period.

13. Payment

Prices quoted apply to cash-on-delivery (COD) or pre-agreed credit arrangements. We reserve the right to refuse orders or discontinue deliveries if payment arrangements or your credit status are unsatisfactory, or if your account is overdue. Payments cannot be withheld as a lien.

14. Cash on Delivery

The amount on the Delivery Ticket must be paid to the driver before materials can be discharged. Terms are COD unless otherwise agreed.

15. Conditions

Any contract resulting from the acceptance of this quotation is subject to these Terms and Conditions of Sale and Delivery, overriding any conditions you may seek to impose. No variation of these Conditions is valid unless signed by a Director of Concrete King.

16. Agreement

The customer's signature on the Delivery Ticket constitutes acknowledgment, agreement, and acceptance of these Terms and Conditions of Sale and Delivery.

All contracts for the sale of goods between Concrete King and its customers incorporate exclusively the Concrete King Standard Terms and Conditions of Sale applicable to the relevant goods. Contracts are concluded at the point of Order Acknowledgement and/or as specified in the standard Terms and Conditions of Sale.
